These Terms of Use (“Terms”) govern your access to and use of Premium Yacht Marketplace™ (the “Site”), an information, media, marketing, and vessel-discovery platform owned and operated by Vigor Media LLC, a Florida limited liability company (“Vigor Media,” “we,” “us,” or “our”). By accessing or using the Site you agree to be bound by these Terms.

1. Nature of the Site

The Site provides yacht-market information, editorial content, marketing content, market analytics, and vessel-discovery tools. Vigor Media is not a licensed yacht brokerage and does not receive, hold, or disburse yacht-transaction funds. Any brokerage services are provided solely by the licensed brokerage referenced on the Site, under separate written agreements between that brokerage and the client.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. If you use the Site on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

3. Informational Purpose — No Warranty

Vessel listings, specifications, pricing, market data, comparables, and editorial content are provided for general informational and marketing purposes only. Content is compiled from owner-provided, broker-provided, manufacturer, public-record, public-market, and other third-party sources and may contain errors, omissions, or outdated information. Nothing on the Site constitutes an offer, contract, warranty, valuation, appraisal, tax advice, legal advice, or investment advice. All information must be independently verified through current documentation, inspection, survey, sea trial, and qualified professional review before any purchase or sale decision.

4. User Submissions and Inquiries

When you submit an inquiry, contact request, or other information, you represent that the information is accurate and that you have the right to provide it. You grant Vigor Media a non-exclusive, royalty-free license to use submitted content for the purpose of responding to your inquiry, connecting you with the referenced licensed brokerage, and operating and improving the Site.

5. Acceptable Use

• Do not scrape, spider, harvest, or bulk-extract content from the Site.
• Do not misrepresent your identity or submit false inquiries.
• Do not attempt to bypass access controls, probe security, or disrupt the Site.
• Do not use the Site for unlawful purposes or in violation of applicable law.

6. Intellectual Property

Premium Yacht Marketplace™ and its original branding, logos, editorial content, page layouts, code, and data compilations are owned by Vigor Media LLC or used under license. All rights are reserved. Third-party names, yacht models, logos, photographs, and trademarks displayed on the Site remain the property of their respective owners. Their display does not imply sponsorship, affiliation, endorsement, or ownership by Vigor Media except where expressly stated. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without prior written permission, except for reasonable personal, non-commercial browsing.

7. Third-Party Links and Content

The Site may reference or link to third-party websites, services, or content. Vigor Media does not control and is not responsible for third-party content or practices.

8. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

9. Limitation of Liability

To the fullest extent permitted by law, Vigor Media LLC and its members, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site.

10. Indemnification

You agree to indemnify and hold harmless Vigor Media LLC from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your use of the Site or your breach of these Terms.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Pinellas County, Florida.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Site after any change constitutes acceptance of the updated Terms.
